The 2020 Title IX regulations made clear that Title IX doesn’t apply to people outside the United States. But a recent court case should serve as a reminder that students who experience sexual harassment while studying overseas can bring costly claims of negligence against their K-12 school, college, or university.

A 10-year review of United Educators’ (UE’s) higher education study abroad claims found sexual misconduct accounted for over half the claims and over two-thirds of the losses. With an average claim loss of nearly $50,000, the study’s findings suggest institutions should do everything possible to protect themselves against financial loss while also protecting students from suffering injuries arising from sexual harassment overseas.
