About This Resource

The Independent K-12 Schools Large Loss Report 2019 summarizes major damage awards and settlements of more than $250,000 that affected independent schools from 2011 to 2018. It can help schools assess their risk management practices and insurance coverage.

The cases include a $25.3 million award in a sexual molestation case, a $16.5 million settlement of more than 400 claims of sex abuse, an $8 million child abuse settlement with 88 former students, a $5.87 million award for an athletics injury, and a $4 million wrongful termination lawsuit.

The summaries in this report are drawn from published accounts, and most do not involve United Educators (UE) members. However, they do reflect trends UE has seen among its claims. In addition to increasingly costly sex abuse cases, complaints involved child abuse, harassment, and wrongful termination.

Some of the outcomes outlined here may have changed because of subsequent legal proceedings since they were reported; however, all the cases demonstrate that losses, in terms of both financial and reputational impact, can be significant. This report can help independent K-12 schools assess their risk management practices and insurance coverage.
