This bulletin addresses problems that increasingly arise from higher education faculty’s use of social media, especially when students view such postings as discriminatory or harassing. The resource examines several United Educators (UE) claims in the area and considers potential liability for institutions arising from their responses to complaints about online speech. The publication recommends that institutions review and revise their faculty handbooks, educate faculty and students on academic freedom (and for public institutions, free speech), develop appropriate guidelines for social media use, carefully evaluate any speech that is potentially harassing or threatening, and develop a crisis communications strategy for responding to troubling online speech.
